Hi everyone!
I've recently discovered a couple of our people haven't had job descriptions issued. I am now pulling together Role Profiles instead for those individuals, so that I can combine the job description and the person spec into one document.
The question I have though is whether you feel Role Profiles/Job Descriptions form part of the Contract of Employment? I have looked on the CIPD forums and the majority of individuals state that they don't form part of the contract and to state this on the Role Profile itself i.e. 'This role profile does not form part of the Contract of Employment and (the employer) reserves the right to make any appropriate changes to meet changing business requirements'. I have put this on the latest ones I'm creating, however I would like to double check with some HR professionals on here as to your thoughts and is what I've found correct? What do your organisations do? Our Contract of Employment states under the 'Duties' section:
The duties of the Employee shall include, but will not be limited to, those duties specified in the Employee’s job description as amended from time to time.
This is the only place whereby the JD is mentioned. Does this mean the JD forms part of our contract?
Thanks very much!

Hi Adele
From your research I would agree and I adopt the same approach the JD does not form part of the contract of employment, but may be referred to within the contract as you describe above. I would always want to keep flexibliity about what duties are or are not included.
We always used to add a sentence too saying any other duties which may be required as reasonably comensurate with the role.
I hope this helps
