COVID-19 Maternity leave

Does anyone know the answer to this question?

Q: For Maternity pay periods would isolation due to pregnancy (vulnerable person)be a reason for starting SMP within 4 weeks of the EWC or would furlough until the EWC be the better option?

  • Hi Caroline

My view would be that if she is not eligible for 'sheilding' and is only regarded as 'vulnerable' she should not be on SSP and therefore the trigger for commencing her Mat Leave earlier (4 weeks prior to EWC) is not met. You can furlough her if she is not willing to work but this could effect her SMP if her pay during the 8 weeks leading up to the qualifying date has dropped to 80%. Is there no work she can do from home to continue working as long as she can?
