    It is not uncommon for employers to have a Company Sick Pay scheme which is based on length of service or an eligibility criteria.

    So for example some employers may state that an employee may become eligible for CSP after they have successfully passed their probationary period.


    Some CSP schemes may also be based on length of service, however in order not to ensure this is discriminatory it is generally accepted that this should not be based on a service length longer than 5 years, anything longer than this is likely to be seen as age discrimination. Unless the employer can argue it is a proportionate means of achieving a legitimate business aim.
