Have you come across this and how has your Company approached it?

The wording in some employees’ contracts could land employers with an unanticipated liability for paying additional holiday, as a result of variations in Easter dates.

The issue will affect employers that operate an annual leave year that runs from 1 April to 31 March, and that set out their employees’ paid annual leave entitlement using wording along the lines of “20 days’ holiday plus bank holidays”.

    My goodness, no, not aware - thanks for the heads up.  I'll be going back to the Senior Management Team today to inform them and once we have a strategy I'll come back.  Most likely we will go for the Employee Agreement to take the extra two days in 2017.

    Although our holiday year runs differently to the example there, we have always had to word our contracts 28 days per holiday year inclusive of bank holidays so years where we've ended up with 9 days of bank holidays, it has given the company the opportunity to decide if they are going to award the extra bank holidays.

    During my time with the company, this has happened twice but on both occasions, it was decided to award the extra day.
