Hi all

Did anyone see this case?

Although this was a case in the Scottish courts so not necessarily legally binding on UK and Wales but still worth reading.

I guess this is something which will need to be taken into consideration especially when dealing with capabiltiy and / or misconduct issues?

What are your thoughts?

    Yes, and I've just read through it again. Wow! Interesting.

    I definitely agree it'll have to be taken into consideration, but, I'm guessing the test will have to be surrounding the severity of the symptoms. Speaking personally, I wouldn't say my symptoms are having a long term and substantial effect on my day to day living (although is throwing open the windows of the office in the middle of January, normal!! lol).

    In all seriousness though, based on the outcome of this case I do think we'll have to be cautious as I'm very aware that so far I'm on the milder side of the scale as far as symptoms go and other ladies aren't so lucky. So yes, I do think that in future this will have to be considered.

    I also think it's a wonderful opportunity for us to look at ways we can support women in the workplace who are experiencing peri-menopause.

      Yes I agree, we had an interesting debate on this in our recent Employment Law workshop and how this affects women and what employees can do to support.

      It would be great to hear any examples of best practice from other group members.
