We have a candidate who had a financial criminal offence and has served time. Applied and interviewed for a job at our Trust.We were unable to get a proper reference from her previous employers as she was dismissed and there was of course disclosure in her DBS, the manager has withdrawn the offer and this candidate has put in a formal compliants for discrimination.Please advise what would best practice be?

This is a tough one!! Did you put in the offer letter that it was subject to satisfactory references? If yes then I would imagine said candidate wouldn't have much to go on and you could formally write back explaining that due to unsatisfactory references the offer has been withdrawn, then give them an opportunity to appeal further?
Was the Manager aware of this before the offer was made?
Sorry this isn't really a definitive answer but would help to know these things. I am just going by my trail of thoughts, sure there must be someone on here who has gone through similar and is able to advise further.

Thanks Rachel. Yes it was still a conditional offer, it was in the process of my team members was seeking references that we got to know this person was dismissed, charged and found guilty. Yes, candidate maintains that having brought it up at interview and Manager re-assure it wouldn't be an issue. Offer has been withdrawn but candidate is now making a formal complaint about unfair discrimination.
