Hi
I wonder if anyone can give me any advice as I am struggling to find an answer to this one.
Our company employs 50 people, of which 49 are based in our HQ in the UK and one (a lady) is permanently based in our branch office in Abu Dhabi, UAE.
She is 16 weeks pregnant and has asked me, as she is resident there, do the UK or UAE maternity leave terms and conditions apply to her?
Her employment contract is UK based, but she is paid in local currency directly into her UAE bank account.
Has anyone any experience of this?
thanks
Carole

Hi Carole
So it sounds like if her employment contract is based on the UK then she is effectively on secondment to the UAE? Albeit as she is permanently based there I would wonder why she had not been localised and placed onto the ts and cs for the country she is based in especially if there is no likelihood of her working in the UK? What are the tax scheme arrangements for her pay?
I think for international reward and assignments it is definitely worthwhile getting professional advice if not sure, I know from experience this can be a minefield and there can also be issues with tax and pension scheme arrangements. Where I used to work we were lucky to have in-house expertise but most large Accountancy firms have a team of people who can provide advice. So you could ask your current accountant and if they don't have the capability ask them to refer you to a firm for specific advice.
Not sure if this is helpful but I hope it gives you some pointers!
All the best
Sarah
