Part time Workers & Bank Holiday Entitlements

I had this issue with a client who is a small retailer the majority of the employees in one shop worked part time generally on Tuesdays, Wednesdays and Fridays for a small number of hours each day. They had prevoiusly simply been taking the bank holidays as paid holiday as and when they fell on a Monday and Friday in addition to their contratual holiday entitlement. This had the effect of mearning the part timers were being treated more favourably than the full time employees.

So we introduced an arrangement where we pro ratd their holiday entitlement in hours and they had to use their annual holiday entitlement on the days when a Bank Holiday falls and they ordinarily worked. We also used the gov.uk holiday entitlement calculator which helped with the transparaency of the entitlements (which you may not about and can be accessed here:)

There is also an intereting case which you can read about here http://www.personneltoday.com/hr/mcmenemy-v-capita-business-service... where it was found the reason for the treatment was not due ot part time status there were specfics to that case i.e they operated a 7 day week not a 5 day week as most 'normal' businesses.
